Anyone know health insurance laws, my Human Resource department made a mistake and they won't fix it?
My Human resource deparment decided on her own without asking that the best insurance for me would be to stop my insurance at the end of November so I could get the Cobra Subsidy because I was getting laid off at the end of December. But I told my boss and he emailed her that I wanted to keep the regular insurance and then they would switch me to the Company Conveinence leave which I would pay half my Insurance in doing this. My boss emailed the Human Resource Department a couple of times and I was ured that this had happened. I got my 1099-HC the other day and it says I was not covered for December, so I called my boss and he checked his emails and he still had the emails saying what I was to be switched to. So now I haven't had insurance for almost 3-months, I contacted her first sh wouldn't respond, then she tried to lie to me and my boss and say that she didn't know I was not supposed to be switched and now after he sent her the emails showing that he had said to put me on the other insurance she says she checked and their is nothing she can do to fix this. I wouldn't mind as much but I checked with my boss over and over and was ured that I was on the right Insurance. Now I am laid off can not get my taxes back until this is fixed and in Machusetts you have to have insurance it's mandatory. The Human Resource lady will not answer calls and my boss says he doesn't know if their is anything we can do. If anyone has any solution to what I can do it would be appreciated very much. It seems wrong that I should get in trouble and not be able to get my taxes because this Human Resource person umed I wanted something without talking to me and was lazy with their job an admittingly said she maid a mistake in not paying attention to the emails and she didn't even know Health Insurance was mandatory in Machusetts. Her quote was "why is it a big deal so he didn't have insurance for a couple months". Please Help
